LIMITED WARRANTY for CPM PRINTING SYSTEMS
MAX USA CORP. (“MAX”) warrants to the original purchaser that this product will be free from defects in material and workmanship when used under normal conditions from the date of original purchase for the applicable warranty periods set forth below. This warranty applies only to MAX CPM Label Printing and Cutting Machines. This warranty covers the printer, the print head, the Main PCB Unit and the other parts that are not specified in Section C “What Is Not Covered”.
A. Warranty Period
Five Years: Printer
One Year: Print Head and Main PCB Unit (Limited to one time replacement)
B. Print Head
The limited warranty for the Print Head is valid only if MAX-approved media is used. Failure to use MAX-approved media voids the print head warranty. The print head warranty does not cover print heads that have been misused, altered, neglected, handled carelessly, or damaged due to improper cleaning or unauthorized repairs.
C. What Is Not Covered
- This limited warranty does not cover defects or damage resulting from improper installation, use outside the product specifications, failure to conduct regular maintenance or cleaning, accident or neglect, failure to exercise caution to protect the printer from electrostatic discharge, adverse temperature and humidity conditions; or any modifications or repairs by anyone other than an authorized MAX service provider.
- The failure to use MAX-approved media will void this limited warranty. Approved media are the consumables such as tape rolls, ink ribbon cassettes and ink ribbon refills manufactured by MAX for your specific printer model.
- Consumable parts, such as blades, cutter holders, dust removers, rollers, slider units and springs are not covered.
D. Warranty Repair Process
For an evaluation of whether a defect covered by this warranty exists, and to obtain warranty service, you must take the product to the retailer or dealer where it was purchased, or deliver the complete product, transportation prepaid, to a MAX authorized service center, together with proof of purchase. If the Printer and/or accompanying items are not covered by this warranty, you will be charged for any service and/or replacement parts/products at Max’s current published rates as well as return shipping. Damage in transit is shipper’s responsibility. Standard ground shipping methods will be used in all cases. For original purchasers in Mexico and Canada: Additional restrictions apply and transportation policy may differ from that stated herein. Contact MAX for details.
E. MAX’s Obligation under Warranty and Disclaimer of all other Warranties
MAX’s sole obligation under the above warranty shall be, at its discretion, to repair or replace products and parts during the warranty period. Products and parts repaired or replaced by MAX under warranty shall be warranted for the balance of the original warranty period or ninety (90) days, whichever is longer.
THE WARRANTY PROVIDED HEREIN IS IN LIEU OF ANY OTHER WARRANTY, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ALL OF WHICH ARE HEREBY DISCLAIMED.
MAX AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY SPECIAL INCIDENTAL OR CONSEQUENTIAL DAMAGES SUCH AS LOSS OF REVENUES OR PROFITS, INCONVENIENCE FOR BREACH OF ANY EXPRESS OR IMPLIED WARRANTY ON THIS PRODUCT WHETHER BASED ON CONTRACT, TORT, OR ANY OTHER LEGAL THEORY AND WHETHER ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Some states do not allow limitations on how long an implied warranty lasts, or allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state in the United States, from province to province in Canada, and from country to country elsewhere in the world.
THE TERMS IN THIS LIMITED WARRANTY STATEMENT, EXCEPT TO THE EXTENT LAWFULLY PERMITTED, DO NOT EXCLUDE, RESTRICT, OR MODIFY, AND ARE IN ADDITION TO, THE MANDATORY STATUTORY RIGHTS APPLICABLE TO THE SALE OF THE MAX PRODUCTS TO CUSTOMERS.
Max’s Limited Warranty Statement is valid only in countries where a covered printer is distributed by an Authorized Max Dealer.
